Manifestation Determination occurs when a student with an Individualized Education Plan (IEP) is being frequently suspended from school. According to the Individuals with Disabilities Education Act (IDEA), revised in 2004, students who have an IEP cannot be suspended from school for more than 10 days (total). Once a student hits the 10-day threshold, a Manifestation Determination meeting must be held to determine the causal of suspension. Children with disabilities should not be punished for their disability (for example, students with Emotional Impairments) and therefore should not receive a suspension if their disability was the main trigger for disciplinary action. Manifestation Determination meetings must occur for every potential suspension over 10 days, and typically include the parent, student, involved teachers, and relevant IEPT members.
If a student is having frequent Manifestation Determination meetings, the team may decide to move the student to a more appropriate location for his or her school success (self-contained classroom or separate school) to meet the student's needs. |
